مبانی کلامی مصونیت غیرنظامیان؛ مطالعه تطبیقی مفهوم حِرِم در عهد عتیق و آموزه عدل و کرامت در سیره علوی

چکیده
مسئله جنگ و تعیین مرزهای اخلاقی آن همواره یکی از چالش‌های بنیادین در الاهیات سیاسی ادیان بوده است. پژوهش حاضر با هدف بررسی تطبیقی مبانی کلامی-خداشناختی مصونیت غیرنظامیان در مخاصمات مسلحانه از منظر الاهیات عهد عتیق و کلام امامیه (متبلور در سیره امیرالمؤمنین علیه السلام) انجام شد. این مطالعه کیفی با روش توصیفی-تحلیلی و رویکرد کلام تطبیقی، داده‌های کتابخانه‌ای مستخرج از نصوص عهد عتیق (با تمرکز بر اسفار تثنیه و یوشع) و نهج‌البلاغه را مورد واکاوی قرار داد. یافته‌ها نشان داد که رویکرد نظامی در بخش‌هایی از نبردهای عهد عتیق بر پایه دکترین کلامی «حِرِم» (نابودی کامل) و نظریه فرمان الهی استوار بود که در آن اراده خداوند مقید به ادراک بشری از عدالت نبوده و محو غیرنظامیان برای حفظ خلوصِ قوم برگزیده توجیه الاهیاتی می‌یافت. در مقابل، سیره نظامی امیرالمؤمنین (ع) مبتنی بر آموزه کلامی حُسن و قُبح ذاتی عقلی و عدل الهی بود که بر اساس آن، جان انسانِ غیرنظامی فارغ از عقیده او، دارای کرامت و مصونیت ذاتی تلقی می‌شد. نتیجه‌گیری شد که تمایز در رفتار نظامی این دو سنت نسبت به غیرنظامیان، صرفاً یک تفاوت فقهی یا تاریخی نبود، بلکه ریشه در تقابل دو دستگاه معرفت‌شناختی متفاوت داشت؛ یکی الاهیات غیریت‌ساز و قوم‌گرا، و دیگری الاهیات عدل‌محور و کرامت‌بنیاد.

The Theological Foundations of Civilian Immunity: A Comparative Analysis of the Concept of Ḥerem in the Old Testament and the Principles of Divine Justice and Human Dignity in the Military Conduct of Imam Ali

چکیده English

The issue of war and the determination of its moral boundaries have always been fundamental challenges in the political theology of religions. The present study aimed to conduct a comparative analysis of the theological and epistemological foundations of civilian immunity in armed conflicts from the perspective of the Old Testament theology and Imami theology (manifested in the military Seerah of Imam Ali, peace be upon him). Employing a qualitative, descriptive-analytical method and a comparative theological approach, this study examined library data extracted from the Old Testament texts (focusing on the Books of Deuteronomy and Joshua) and the Nahj al-Balagha. The findings revealed that the military approach in certain Old Testament battles was based on the theological doctrine of "Herem" (total destruction) and the "Divine Command Theory," where God's will is not constrained by human perceptions of justice, thus providing theological justification for the annihilation of civilians to preserve the purity of the chosen people. In contrast, the military Seerah of Imam Ali (AS) was founded upon the theological doctrines of "inherent rational good and evil" and "Divine Justice." Accordingly, the life of a civilian, regardless of their beliefs, was considered to possess inherent dignity and absolute immunity. It was concluded that the disparity in the military conduct of these two traditions towards civilians was not merely a jurisprudential or historical difference; rather, it was rooted in the confrontation of two distinct epistemological systems: an exclusionary and ethnocentric theology versus a justice-oriented and dignity-based theology.
